Possession for the Purpose of Trafficking 2kg’s of Cocaine – R v BS and MT

Counsel’s client was charged with possessing two kilograms of cocaine. The cocaine was indisputably found in their bedroom, in a suitcase tucked into their closet. Ms. T was in the apartment when a warrant was executed. She was the sole occupant of the home. Other evidence suggested that only one other person had regular independent access to the apartment – the co-accused. Through cross-examination and submissions, defence counsel raised a doubt in the Court’s mind about how the cocaine ended up in his client’s bedroom and whether she was aware that it was there.
